Family Court review overdue – counsellor

The Family Court system has been labelled “a fractured matrix”, with one family counsellor saying a review is overdue. Justice Minister Simon Power yesterday released the terms of reference for the review, expected to be available for public consultation in September. In addition to considering ways to encourage people to resolve relationship disputes outside court, it will look at the state’s role in the court, the purpose and functions of the court, and the role of lawyers, mediators, psychologists and social workers. Mr Power said the court’s expenditure had increased from $83.9 million in July 2005 to $137.1 million, with legal aid and family-related services among the significant drivers of costs. Steve Taylor, the director of Auckland-based counselling and mediation organisation 24-7, welcomed the review today, saying the “tattered legal jigsaw” within the court’s system was unsuitable for helping families in crisis. “The New Zealand Family Court system is a fractured matrix unfamiliar with the best practice evidence for working with families in a either a legal or best-practice context.” Mr Taylor said international research showed a number of the New Zealand processes were inefficient. In particular, he questioned the appropriateness of using the legal system to deal with most family disputes, and the role of compulsory mediation.

    I am living the result of very badly made desisions with my husbands divource.
    He is now unemploeyed and yet I am forced to pay $2500 a month in interest, because we have to house his x-wifes parents that the family court made him continue looking after. Because they squatted in his rental for free, for 8 years, before his x wfe left him for another man. I met him 18 months later- but because she got the courts sympathy- single mother 3 children no job at the time and her parents were sickness benificeries- he was in a relationship with me working
    -her man had left her.
    We got stuck with them as well.
    Doesnt matter now that they have 3 adult children of there own working one with rental houses. They are no relation to us now.
    My husband cannot sell the house they are in, and we are close to bankruptcy. Cannot aford our own house now. His X has attacked me- punched me in the face. I do not even know these people to have a conversation with them, but they bludge off us and caused my husband to consider suicide as he thought the strain was too much he was at the end of his teather. A good Father- overly generous husband to his x Family.
    Why cannot we get a true divource? I dont want them in our new life!
    This is total rubbish. The kids are suffering for this stupid situation- we cant afford the child support and the grandparents as well!
    The X inlaws have not worked since there 40’s and are professional bludgers. Now in their 70’s they use that as their sympathy vote. Sold their own house to bludge off Tony.
    I dont want them in my life-how can they do this to me? Lawyers just told me we had been done like a dogs breakfast- the Judge was potty and they got rid of him – but they cant fix our delema -too hard basket.
    Family courts in NZ cause more fights than harmonious living. I live it- I know.
    Change it quick and put someone in there with at least half a brain Please!!! This is just insane.
